1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of testrightacademy.com, including the training modules, knowledge quizzes, certificates, qualification packets, and any related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. The Service

TestRight Academy provides:

• Self-paced knowledge modules with interactive quizzes and Certificates of Completion. These are educational and do not by themselves qualify you for any federal collector or BAT qualification.
• Live, instructor-led Zoom training for DOT Urine Collectors (§40.33), Oral Fluid Collectors (§40.35), and Breath Alcohol Technicians (§40.213), including 5 observed mock collections and a printable qualification packet.
• Educational resources on workplace drug testing compliance.

3. Eligibility

You must be at least 18 years old to use the Service. By using it you represent that you meet this requirement.

4. Accounts

• You're responsible for keeping your password confidential.
• You're responsible for all activity under your account.
• Provide accurate information; let us know if anything changes.
• Notify us immediately if you suspect unauthorized access.

5. Payments & refunds

Paid programs (DOT Urine, DOT BAT, Complete Bundle) are sold as one-time purchases with lifetime access to the materials. We use a third-party payment processor; your card information is never stored on our servers.

Refund policy — DOT collector qualifications: If you have not yet attended your scheduled live Zoom session and have not downloaded any qualification packet, you may request a full refund within 30 days of purchase. After attending a live session or downloading a qualification packet, all sales are final.

Refund policy — audit-ready compliance certificates (HIPAA, OSHA Bloodborne Pathogens, DOT Reasonable Suspicion & DER, harassment prevention, workplace violence prevention, drug-free workplace, and driver drug & alcohol awareness): these are sold as one-time purchases. You may request a full refund within 14 days of purchase only if you have not started or opened the course module. Because the training content is delivered immediately upon access, once you open or begin the module all sales are final.

6. Acceptable use

You agree NOT to:

• Share your account credentials or let another person use your account.
• Reproduce, redistribute, sell, or modify any course content without our written permission.
• Falsify or misrepresent any certificate, score, or qualification.
• Attempt to disrupt or compromise the security of the Service.
• Scrape, copy, or extract content for use in a competing product.
• Use the Service in violation of any applicable law.

7. Certificates & qualification packets

A Certificate of Completion from the self-paced module system documents that you completed the knowledge training portion of a course and passed the final test (80%+). It is NOT, by itself:

• A federal qualification or certification by DOT or any other agency;
• A substitute for the §40.33/§40.35/§40.213 mock-collection qualification;
• A guarantee of employment.

Bloodborne Pathogens (OSHA 29 CFR 1910.1030) and HIPAA certificates require annual retraining; your certificate is dated and the user is responsible for renewing on schedule.

A Qualification Packet (from our live Zoom program) documents that you completed §40.33/§40.35/§40.213 mock collections under the observation of a qualified evaluator. The packet is the documentation; the underlying qualification is conferred by the actual completion of the mocks, not by the packet alone.

8. Intellectual property

All content on the Service — including text, graphics, code, quizzes, certificate designs, and trademarks — is owned by TestRight Academy or its licensors and is protected by copyright and other laws. You receive a personal, non-transferable, non-exclusive license to access and use the content for your own training. No other rights are granted.

9. Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

The content on this site is educational; it is not legal, regulatory, or professional advice. Always consult a qualified compliance professional and refer to the current version of any cited regulation before making business or operational decisions.

We do not guarantee that any program — including ones that satisfy DOT training elements — will result in employment, contracts, or any specific compliance outcome.

10. Limitation of liability

To the maximum extent permitted by law, TestRight Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or in connection with your use of the Service. Our total liability for any direct damages is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold TestRight Academy harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of the Service.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that harms the Service or other users. You may delete your account at any time by contacting us.

13. Changes

We may update these Terms. Material changes will be announced on this page; the "Effective" date at the top reflects the most recent revision. Continued use after a change constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in New York.
