Most DOT-regulated employers must have a written drug & alcohol testing policy and provide it to covered employees — but that obligation comes from the modal agency rule (for FMCSA it is §382.601), not from Part 40. Part 40 prescribes how DOT tests are conducted; the modal rule supplies the policy, distribution and programme requirements, and they differ between agencies.
